McClendon of the County of Ozark, State if Missouri party of the second part, and The Bank of Gainesville of the County of Ozark, State of Missouri party of the third part: WITNESSETH, That the said parties of the first part, in consideration of the debt and trust hereinafter mentioned and created, and of the sum of One Dollar to them paid by the said party of the second part, the receipt of which is hereby acknowledged, do by these presents GRANT, BARGAIN AND SELL, CONVEY AND CONFIRM, unto the said party of the second part, the following described real estate situate, lying and being in the County of Ozark and State of Missouri, to-wit: The Northeast NE ¼ of the Southeast ¼ and the Southeast ¼ of the Northeast ¼ all in Section 23 of Township 23 of Range 16. TO HAVE AND TO HOLD THE SAME, with the appurtenances, to the party of the Second Part, and to his successor or successors in this Trust, and to him and his grantees and assigns, forever. IN TRUST, HOWEVER, for following purposes: Whereas, J. C. Wallace and Saloma E. Wallace, his wife the said parties of the first part have this day made, executed and delivered to the said party of the third part, their Promissory Note of even date herewith by which they promise to pay to the said Bank of Gainesville or order, for value received, Eighty-eight & 50/100 Dollars, described as follows: $88.50 Gainesville Missouri, Sept 6th 1899, six months after date we promise to pay to the order of the Bank of Gainesville, Eighty-eight & 50/100 dollars, for value received payable at the Bank of Gainesville, Gainesville, MO with interest from date at the rate of 8% per annum and if the interest be not paid annually, or when due to be added to and become a part of the principal and bare the same rate of interest. NOW, THEREFORE, If the said parties of the first part, or any one for them, shall well and truly pay off and discharge the debt and interest expressed in the said Note, and every part thereof, when the same becomes due and payable, according to the true tenor, date and effect of said Note, then this deed shall be void, and the property hereinbefore conveyed shall be released at the cost of the said parties of the first part; but should the said first parties fail or refuse to pay the said debt, or the said interest, or any part thereof, when the same or any part thereof shall become due and payable, according to the true tenor, date and effect of said Note, then the whole shall become due and payable, and this Deed shall remain in force; and the said party of the Second Part, or in case of his absence, death, or refusal to act, or disability in anywise, the (then) acting Sheriff of Ozark County, Missouri, at the request if the legal holder of the said Note may proceed to sell the property hereinbefore described, or any part thereof, at public venue to the highest bidder, at the Court House door, in the town of Gainesville, Ozark County, Missouri, for cash, first giving 20 days public notice of the time, terms and place of sale, and of the property to be sold, by advertisement in some newspaper printed and published in the County of Ozark and upon such sale, shall execute and deliver a Deed in fee simple of the property sold, to the purchaser or purchasers thereof and receive the proceeds of said sale, and any statement of facts or recital by the said Trustee in relation to the non-payment of the money secured to be paid, the advertisement, sale, receipt of the money, and the execution of the Deed to the purchaser, shall be received as prima facie evidence of such fact, and such Trustee shall, out of the proceeds of said sale, pay, first, the costs and expenses of executing this Trust, including legal compensation to the Trustee, for his services, and next he shall apply the proceeds remaining over to the payment of said debt and interest, or so much thereof as remains unpaid, and the remainder, if any, shall be paid to the said parties of the first part, or their legal representatives. And the said party of the second part covenant faithfully to perform and fulfill the trust herein created, not being liable or responsible for any mischance occasioned by others. And it is further agreed and understood that in case default be made in the payment of the debt and after sale the parties of the 1st part shall become tenants of the party of the second part and give possession after ten-day notice. Wallace of Ozark County, State of Missouri, parties of the first part, and the County of Ozark in the State of Missouri, party of the second part: WITNESSETH, That the said parties of the first part, in consideration of the sum of One Hundred and forty-three 45/100 Dollars, to us paid by said party of the second part, the receipt of which is hereby acknowledged, do by these presents Grant, Bargain and Sell, Convey, and Confirm, unto the said party of the second part, the following described lot, tract or parcel of land, lying, being and situate in the County of Ozark and State of Missouri, to-wit: SW ¼, NW ¼, & NW ¼ of Section No. Twenty-five (25) and East ½ NE ¼ Section No. Twenty-six (26) all in Township No. Twenty-three (23), Range No. Sixteen (16), containing 160 acres more or less. TO HAVE AND TO HOLD the premises aforesaid, with all and singular the rights, privileges, appurtenances and immunities thereto belonging or in anywise appertaining, unto the said party of the second part, upon this express condition: WHEREAS, the said J. C. and Saloma E. D. 1903, the said sum of borrowed money, with interest thereon from the date of said Bond until paid at the rate of 8 per cent per annum; said interest to be paid annually, on the 30th day of Ded of each and every year, until the whole debt shall be fully paid off and discharged. NOW, THEREFORE, if the said Principal and Securities shall well and truly pay or cause to be paid the said sum of money borrowed and all the interest thereon, according to the tenor and effect of said Bond, then this Deed shall be void, and it shall be released at the proper cost and expense of the said parties of the first part. But should default be made in the payment of the principal or interest, or any part thereof, at the time when they shall severally become due and payable, according to the tenor and effect of the said Bond, the then acting Sheriff of the said County shall have power to, and may, without suit on this Deed of Mortgage, proceed to sell the property herein conveyed and mortgaged, first giving 20 days’ public notice of the time, terms and place of said sale, by publication in some newspaper printed and published is said County, if any such there be, and if not, then by six printed or written handbills posted up at six public places in said County, at which sale the said property shall be sold to the highest bidder for cash in hand, and the said Sheriff shall make an absolute conveyance in fee of the property thus sold, to the purchaser or purchasers thereof, which shall be as effectual to all intents and purposes as if such sale and conveyance were made by virtue of a judgment of a Court of competent jurisdiction foreclosing this mortgage. And out of the proceeds of said sale, the said Sheriff shall pay, first, the cost and expenses attending such sale and conveyances; the second, the debt and interest due the County, and the remainder, if any, shall be paid to the said parties of the first part, their heirs, executors or administrators. Harlan, they executed a Trust Deed with Bank of Gainesville and Trustee J. C. Harlan for $4,722.48. Default occurred after Joseph Homer died in 1931. This deed provides for the sale of the real estate at public auction to the highest bidder for cash, at the Courthouse in Gainesville, Ozark Co, Missouri on June 10, 1933. A. L. 8128 | Unexpected results when well drilled on Homer Wallace farm Mountain Home, Dec. 27.--While drilling a well on the Homer Wallace place at Three Brothers, Monday, Jim Martin sent his drill into a heavy run of lead ore at the 120-foot level. The vein of ore continued to a depth of 129 feet, where drilling stopped. Pieces of lead as large as wheat kernels came up with the cuttings on the drill. |

It was acquired by the War Department in June 1941 for use as an Army transport. On 29 Sep 1941, the Acting Chief of Naval Operations, Rear Admiral Royal E. Ingersoll, sent a memorandum to the Chief of the Bureau of Navigation, listing a number of Army transports, including Thomas H. Barry, that were to be "eventually taken over by the Navy." The Thomas H. Barry was later designated AP-45. However, the transport was never taken over by the Navy and remained under Army control through the end of World War II. |

8134 | USS Finland Troy left St. Nazaire, France on 31 Jan 1919 aboard the USAT Finland and arrived in Hoboken, New Jersey on 14 Feb 1919. At the entry of the United States into World War I in April 1917, the liner was chartered by the United States Army as USAT Finland. She made five transatlantic runs under Army control ferrying troops to Europe. On the return portion of her third voyage, Finland was torpedoed by U-93, but was able to safely return to port for repairs. In April 1918, Finland was transferred to the U.S Navy and commissioned as USS Finland. She completed an additional five voyages to Europe, carrying almost 13,000 troops. After the Armistice, she returned over 32,000 troops to the United States before being decommissioned in September 1919. |
