This day came the parties aforesaid by their attorneys, and thereupon came also a jury of good and lawful men to wit, Robert Hunter, Isaac Nance, William Arnold Jr., Josiah Martin, Gwin Howell, Melchisedick Self, William Smith, Isaish Dickson, Henry Windroe, John Martin, Marquis Sharpe, Joseph Canon who being elected tried and sworn the truth to speak upon the issues joined upon their oaths do say that the Defendant hath paid twenty dollars & fifty cents part of the debt in the declaration mentioned and they asses the Plaintiffs damages by reason of the detention of that residue of that Debt to Seven dollars seventy seven and one-half cents, besides his cost. Therefore it is considered by the Court that the Plaintiff recover against the said Defendant one hundred and eighty-three dollars the residue of the debt in the declaration mentioned, together with the damages by the Jury in the manner and form aforesaid assessed and his costs by him in this behalf expended and the said Defendant in Mercy, etc. |

(1) William Ingram vs Stethmead Laughlin ) Joseph Thompson and John Davidson who are special bail of the defendant come here into Court & surrenders the body of the Defendant in Discharge of themselves as such - and thereupon James Berry comes here into Court and acknowledges himself as special bail of the said defendant and thereupon by consent of the parties it is ordered by the Court that the matters in dispute be and are hereby referred to the arbitrament and award of Charles Ready, John Renshaw, Francis Youry, Jonathan Hall, Robert Kirk, John Berkley, John Bankhead, Joshua Barton, Richard I. Conn, James Bell, Robert Carson, and George Brannon and their award to become the Judgement of this Court. (2) Jonathan Hall & Joseph Thompson administrators of James Thompson dec'd makes return of the amount of sales of said Estate which is ordered to be recorded. (3) Francis Youry vs. Joseph Thompson, Henry Goodloe, John Thompson. This day came the defendant in their proper persons and saith that they cannot gainsay the said Plaintiff's action for One Hundred and sixty-three dollars seventy and one-half cents - therefore by consent of the parties and with the assent of the Court it is Considered by the Court that the said plaintiff recover against the said defendants the said sum of one hundred and sixty-three dollars & seventy-two & one-half cents & his costs in his behalf expended - and thereupon the said Plaintiff acknowledges the receipt of Seventy-two Dollars part of the above judgement - Wherefore it is ordered by the Court that from so much of said Judgement the Defendants be acquitted & released. |

It appearing to the satisfaction of the Court here that Mary Thompson, widow of James Thompson late of said County of Rutherford deceased, who was heretofore appointed by this Court as guardian for the minor Heirs of said James Deceased is wasting the property of the Heirs aforesaid and improperly converting the money of said Orphans to her own private use, therefore it is ordered by the court here that the guardian bond entered into in this behalf of said Mary as guardian aforesaid be set aside & for naught esteemed from the present date, and that Robert McCombs be and is hereby appointed guardian for said minor Heirs & thereupon the said Robert came into open Court & gave bond with Francis Youree & William McMurry as his securities for his faithful guardianship. |

Will of Joseph Thompson [p 310] Joseph Thompsons Will. In the name of God Amen. I Joseph Thompson of the county of Rutherford and state of Tennessee being of sound mind and memory, calling to mind the mortality of my body and knowing it was appointed for all men once to die do make this my last will and testament. First of all, I recommend my soul into the hands of God who gave it and my body to be buried in a decent Christian like manner at the discretion of my friends.
With regard to the property, it has pleased God to bless me with it is my will it shall be disposed of in the following manner after all my Just Debts are paid. I give and bequeath to my beloved wife Isabela the house wherein I now live with Eight acres of the improved land also a lot joining the house with as much of the household furniture as she may think she will need during her natural life also one negro girl named Mill with one brown filly known by the name of Elizabeth’s filly out of my stock of cattle two of her own choice, the above named property she is to hold during her natural life, at her death it is to be sold and disposed of in the manner hereafter mentioned.
Item 2nd I give and bequeath to my son John the plantation whereon I now live supposed to contain one hundred and sixty acres with two hundred dollars in money to be paid when made out of my property.
Item 3rd To my four grandchildren, viz. William McCombs, Rosanah McCombs, Jane Thompson and Mary Thompson to the above-named children I give and bequeath one hundred dollars to each. I also give and bequeath to Elizabeth Kelly’s son Samuel one hundred dollars. The balance of my property not mentioned in this will consisting of Negroes, horses, cattle, household and kitchen furniture, to be sold on a credit of twelve months, except my manual tools I give to my son John. The money [p 311] arising from the sale of my property I wish to be equally divided between my two daughters Ann Thompson and Isabela McCracken, except Elizabeth Kelly should recover from her present sickness. If so I wish her to have an equal share with the two last mentioned.
My farming tools I give to my wife Isabela. At her death all the property willed to her I wish to be sold and the money equally divided among my two daughters above named except one hundred dollars I will and bequeath to Jane Allen and I do hereby appoint Joseph McCracken and Robert Thompson.
