- Two Battles of Augusta. Unfortunately for the cause of peace, gangs of marauders roamed the region between Savannah and from his haven in North Carolina, rallied 600 men who had taken a recent oath of allegiance to the king, and attacked Augusta on September 14, 1780. In a desperate four-day battle Clarke besieged Brown and his Rangers and Indian allies at the Mackay House outside town. Lieutenant Colonel John Harris Cruger and his New York loyalists from Ninety-Six came to the relief of Brown's garrison. Though tradition blames Brown for hanging thirteen prisoners, Cruger probably gave the order to carry out the punishment mandated by Cornwallis for those who took up arms after swearing allegiance to the king. Clarke beat a hasty retreat to North Carolina, hounded by Indians and loyalists. Cornwallis dispatched a force of loyalists under Lieutenant Colonel Patrick Ferguson to cut off Clarke's band. Instead, Clarke's friends from the mountains swarmed down under their own leaders, caught Ferguson on Kings Mountain, and scored a decisive victory on October 7, 1780. Clarke's raid upon Augusta triggered the events that led to Kings Mountain.

Under the Georgia headright law, each head of a family was allowed two hundred acres plus fifty additional acres for each family member or slave, the total not to exceed one thousand acres. William [Shepherd] Foster's grant was dated 4 Sep 1783 and executed on 4 Oct 1783. 550 acres on Little River. Joining Jno. Jones, Edward Blake, and Absalom Bidell. Original Plat No. 80, pg 26 [original page number in the respective plat book]
NOTE: The Land grant process basically took these steps: (1) application and issuance of a Warrant for a survey, (2) presentation of the warrant to the appropriate official for a Survey to be conducted and a plat to be drawn up, (3) the recording of the plat and payment of the grant and office fees. Once grant and office fees were paid and appropriate copies were recorded with the Surveyor General's and Secretary of State's offices, the Grant was signed by the governor. Then it was returned to the county surveyor to be recorded in the county records and delivered to the grantee. If the grant fees and office fees were not paid into the state treasury within one year of the date of the warrant, the grant would be deemed lapsed and could be issued to any qualified person who should apply for it. |

Will of William Shepherd Foster Jr. Will of William Foster. "In the name of God amen. I William Foster, of the County of Green & State of Georgia, being in good health and of a sound mind, a memory and calling to mind the uncertainty of this transitory Life do make and ordain this my last Will and testament, in manner and form following.
It is my will and desire that all my debts should be paid out of my Estate.
--Item. I give my Daughter Salley Smith, one negro girl named Esther.
--Item. The Land whereon my son Truett Foster now lives upon I have given him as his part.
--Item. The Land that I gave my son James Foster that he sold to his uncle Philemon Foster to be his part.
--Item. The Land that I gave my son Spencer Foster that he sold to Reuben Foreman to be his part.
--Item. I lend my daughter Elizabeth, one negro girl named Rose, during her natural Life, and after her death I give the said girl to her children.
--Item. I give my Daughter Polly Smith one negro boy named Philip.
--Item. I lend my Daughter Phebe Catuehead one negro girl named Nancy, and after her death I give the said girl to the children of her body.
--Item. I give my daughter Rutha Foster one negroe woman named Patience also one bed & furniture.
--Item. I give unto my daughter Patsey Foster one negroe girl named Rachel also one bed and Furniture.
--Item I give my daughter Rebeckah Foster one negroe boy named Fendahl & one negro girl named Linda, also one bed & Furniture.
--Item. I give my son Shadrack Foster one negro boy named Sam, and whatsoever I am possessed of at my death. except what I have already given.
I do hereby acknowledge this to be my last will & testament, utterly disannulling all other wills made by me heretofore made by me. I do appoint William Johnson & John Slaughter Executors to this my last Will & Testament. In witness whereof I have hereunto set my hand and seal this 3rd day of December in the year of our Lord 1808.
