Sheriff’s Deed in Partition To all To Whom These Presents Shall Come. I, William Mahan Sheriff of Ozark County, in the State of Missouri send Greeting: Know ye, that whereas, at the August Term 1905 of the Circuit Court of the County of Ozark in a certain suit then pending in said Court, wherein James C. Wallace was petitioner, against John T. Wallace, Ephraim H. Wallace, Sarah J. McGuire, Noah McGuire, Martha Hutchings, Ellen Ellis, Robert Ellis, and Joseph M. Wallace. Defendants for the partition of the following described Real Estate, situate lying and being in the County of Ozark and State of Missouri, descending to them as the heirs and legal representatives of David O. Wallace, deceased, to-wit: the S.W. ¼ of Section 25 & the North ½ NW ¼ and the SE ¼ NW ¼ of Section 36 Twp 23 Range 16. The said Court then and there decreed, that partition of said land be made among the parties, according to their respective interests and it appearing to said Court that said land could not be divided in kind amongst the parties therein, it was thereupon ordered and decreed by said court, that the Sheriff of said County of Ozark, proceed to advertise and sell the same according to law, all of which facts and orders of court fully appear from the records of said Circuit Court, And Whereas a certified copy of said order of sale was duly made out by the Clerk of said Court and to me the said Sheriff, dated Dec 21st of 1905; and whereas, in obedience to said order of sale, I, the said Sheriff did cause the Real Estate to be advertised for sale for a period of twenty days, next before the day of sale thereof, by advertisement in the “The Republican” a newspaper printed and unpublished in the said County of Ozark containment a particular description of the Real Estate to be sold, and stating the time, place and terms of sale; And Whereas, in obedience and conformity to said order of sale and advertisement aforesaid, I, the said Sheriff of said County did on the 13th day of February 1906 at the February term of the Circuit Court for the year 1906 and while said Court was in session, between the hours of nine o’clock in the forenoon and five in the afternoon of that day proceed to offer and expose to sale, at public action to the highest bidder, on the following terms, viz: To the highest and best bidder for cash, at the courthouse door in the town of Gainesville in said County of Ozark the said Real Estate above described , and having so offered and exposed the same for sale for a long space of time as aforesaid and James C. Wallace being the best highest and last bidder for the following described part of said Real Estate, became the purchaser thereof, for the price and sum of Sixty Dollars and __ cents, to-wit: ____ And whereas, the said James C. Wallace has fully paid and satisfied to me the full amount of money by his bid as aforesaid, for said last described Real Estate; Now Therefore, known all me by these presents, that, I, William Mahan Sheriff of said county by the power and authority in me vested in the premises, as such, can sell and convey the same. In Testimony whereof, I, the said sheriff have hereunto subscribed my name and affixed my seal this 13th day of February 1906. [Signed] William Mahan, Sheriff (seal). State of Missouri, County of Ozark} ss. In the Circuit Court, February Term A.D. 1906. Be it remembered, that on this 16th day of February in the year of our Lord 1906, before the Hon. John T. Moore, Judge of the Circuit Court, within and for the County aforesaid, came into open William Mahan, who is personally known to the said judge to be the same person whose name is subscribed to the foregoing instrument of writing as having executed the same and also know to the Sheriff of the County of Ozark aforesaid, and then and there, in open court, before the said judge, acknowledged the said instrument to be his act and deed for the purposes therein mentioned, this Certificate of Acknowledgment being ordered by the said Court to be endorsed by the Clerk on this deed. In testimony whereof I, James P. Gaulding Clerk of our said Court have hereunto set my hand and affixed the seal of said Court done at my office in Gainesville, MO in the County aforesaid.
